Republic of Serbia's National Parliament conclusions about the situation in Kosovo and Metohija and participation of our deleg February 11, 1999
CONCLUSIONS I 2. The acting of NATO presents an open threat of aggression against sovereignty and territorial integrity of the FR of Yugoslavia, as an independent country, founder and member of the United Nations, which is violation of the UN Charter's principles, especially the article 2, paragraph 4 of the UN Charter. 3. NATO is a regional, military organization, and article 53, paragraph 1 of the UN Charter explicitly underlines that regional arrangements or regional organizations cannot undertake any forced action without the authorization of the Security Council. The UN Security Council has not authorized NATO to undertake forced measures against the FR of Yugoslavia, and therefore the NATO's threat presents a direct violation of the UN Charter and endangers sovereignty and territorial integrity of our country. 4. The National Parliament considers that through such an acting, NATO destroys basic principles of the international relatinos, the foundations of the international order and presents a threat for international peace and security. 5. The FR of Yugoslavia is pursuing an open policy of peace, good-neighbourly relations and egual cooperation towards all countries and organizations, that accept such a cooperation, and it neither endangers anyone, nor there is a threat for anyone from its territory. Pursuing consistently the policy of peaceful solving all the open issues, the FR of Yugoslavia is an element of peace and stability in the region. We are determined in protection of our legitimite state and national interests, foremostly ostly the sovereignty and territorial integrity of the country, in accordance with the UN Charter's principles, the Final Act from Helsinki and the Paris Charter. 6. The Republic of Serbia's National Parliament stresses that in the case of aggression against our country, its sovereignty and territorial integrity, freedom, independence, lives and property of our citizens, we shall defend with all available means. We are determined and united in defending our homeland. II 2. The Contact group is knocking on the open door, with its invitation for talks. Serbia and the FR of Yugoslavia have proved that they were for the political solution, doing everything to achieve it through dialogue by all the national communities in Kosovo and Metohija. 3. Stressing the determination for peaceful and political solution of the current problems in Kosovo and Metohija, the National Parliament also points on significant, intolerable and very one-sided stands in Contact Group's proposals, that are inappropriate towards a sovereign country. 4. Along with declarative advocating for the sovereignty and territorial integrity of Serbia and the FR of Yugoslavia, at the same time solutions, that endanger and put under question our sovereignty and integrity are also offered, proposing even confederal elements, such as necessary consent of Kosmet, when it is the matter of changing borders of Kosovo and Metohija, and proclaiming emergency situation. 5. The countries, which are formally advocating for the sovereignty and territorial integrity of Serbia and the FR of Yugoslavia are at the same time threatening and sending millions of US dollars in financial support, arms and equipment for terrorists. 6. It should be especially condemned that part of the international community supports the subjectivity of separatists and terorrists on one internalissue - that is the right of a country to fight against separatism and terorrism - and puts a sovereign country and those who want to destroy it on an equal footing. 7. It is particularly unacceptable to equal the responsibility of the state bodies and criminal groups for the situation in Kosmet. Legal actions of the state bodies against terrorism cannot be characterized as repression against civilians, and at the sametime terrorism in all its forms - assaults, killings, kidnappings - as provocations. 8. The international community hasn't assessed the essence of the activity of the so called KLA, as a terrorist organization, and doesn't undertake measures against it as against other terrorist organizations in the world. 9. Underrating past efforts in searching for the solution throught political means is not acceptable, as well as trying to annul the agreement between the FRY President and the international community, which is expressed in the Government's stands from October 13-th and the Agreement with the OSCE from October 18-th 1998, and the principles set in them - being: it is the internal question of a sovereign country; that terrorism and separatism should stop; that any solution should be in accordance with Constitutions of the FRY and the Republic of Serbia and that it cannot put under question sovereignty and territorial integrity of our country. 10. The National Parliament stresses the democratic substance of the common proposal on the Agreement about political framework for the autonomy in Kosovo and Metohija, from November 20-th 1998, which was signed by two Kosovo Albanians' political parties, representatives of the Muslim, Turkish, Gipsies, Gorancis' and Egiptian national minorities and by representatives of the parlamentarian parties from Kosovo and Metohija. Ignoring and undervaluating the existence of national communities and ethnic groups is unacceptable, as well as the necessity for full equality of all the national communities, living in Kosovo and Metohija. 11. Concerning a demand "that sides should accept the level and character of international presence, which the international community considers as appropriate", the National Parliament states: size and character of the international presence at Kosmet is finally defined in the agreement between the FRY President Slobodan Miloševic and ambassador Richard Hoolbrook, and based on that in the Agreement between the Federal Government and the OSCE on establishing the OSCE Verification Mission in Kosmet. 12. The National Parliament expresses its utmost astonishment about the demand "that federal and republican legal frameworks should be harmonized with the interim agreement for Kosmet", since it is contradictory to any logic and principles of the constitutional law, and would present legal and constitutional prescedent meaning that a wider community should adjust to the part of smaller community. 13. Deducing the rights of other national communities, in solutions for Kosmet, on some kind of cultural rights, is a discrimination and enters the possibility that through concrete solutions a majorization can be achieved by the Albanian national community, which would directly destroy the principle of equality, and introduce the existence of first and second rate citizens. 14. The National Parliament stresses that every demand for "substantial autonomy " and " high degree of self-governance "for Kosmet neither can lead to the independence for Kosovo and Metohija in further negotiations, nor to the status of the third federal unit, but that such an autonomy cannot mean breaking legal, political and economic ties with in the Republic of Serbia. 15. The National Parliament also stresses that the so-called interim status for Kosmet cannot be neither hidden nor explicit way to separatism, but only a possibility that, after certain number of years, the agreement's signatories can reconsider that status aiming to improve its implementation and consider proposals of any signatory, for additional measures, whose adopting will require consent of all the signatories. III 2. The FR of Yugoslavia, as an independent and sovereign country, is pursuing the policy of peace and peaceful cooperation, it doesn't endanger anybody, and there is no threat from its territory to anyone. In accordance with those principles, the FR of Yugoslavia is ready to solve all the open issues through peaceful and political means, and to protect desicively its legitimate, state and national interests, especially the sovereignty and territorial integrity, based on the UN Charter. IV 2. This is the main obstacle for achieving the political solution. The Albanian separatistic parties and their leaders have reacted with rejection and obstruction on all the efforts, offers and good will of the state, that they should rejoin the political dialogue and search for solutions together with the others. Such their stand was provoking and encouraging the continuation of crimes by terrorist gangs. They have misused respect for the agreement by our country and the presence of the OSCE Verification Mission, and continued with crimes. 3. The Republic of Albania is openly and directly on the side of Albanian separatism and terrorism. Albania has been transformed in a terrorist country - a base for terrorists and fundamentalists, the center for training, arming, financing and every other support for their criminal goals towards the FR of Yugoslavia and other countries in the region. 4. Part of the international community hasn't condemned unreservedly separatism and terrorism with any single act, nor has it prevented, with any single act, the Republic of Albania to become a logistics base for terrorists and separatists in Kosovo and Metohija. After almost three mounths, the Organization for Security and Cooperation in Europe hasn't completed its composition with 2.000 verificators in Kosmet, and isn't completely capacitated to inform impartially and correctly the international public and international organizations about the truth on the ground. The truth is that since signing of the Agreement and arrival of verificators, the escalation of terrorism was recorded. 5. Part of the international community is all the time pursuing the policy of double-standards, preventing in that way any, at least the most moderate, attempt of condemning terrorist gangs by the UN Security Council. Such an acting on the side of the part of the international community actually is support, assistance and encouraging of the separatists and terrorists. 6. Through fabricated and incorrect assessments that army and police are using force excessively, there are attempts to prevent legitimate forces to defend the nation and the state, and to act against terrorists adequately, like it is the case with army and police in all countries worldwide, which are facing with this evil. Through this, it is the intention to try to annul the stand, that has been agreed upon with the international community, in which it explicitly states "that state bodies reserve the right to respond adequately on any from of terrorist activity and violation of the law, that can endanger lives and security of citizens and government representatives". 2. The National Parliament once again confirms the principles, on which the Kosovo and Metohija crisis can be resolved successfully, lastingly and in the interest of all. These principles are: VI 1. The Republic of Serbia's National Parliament has decided to accept the invitation for talks because the strong determination of peoples and all the political parties is that we are fighting for peace and that we should defend Kosovo and Metohija on every place in the world where the issue of Kosmet is being discussed. By accepting the talks we are making one more step in contribution to the solving of problems through peaceful means. 2. The National Parliament authorizes the Government to appoint a delegation, that will participate in these talks.
